Privacy Policy

GMTech Corp (“GMTech,” “we,” “our,” or “us”) takes your privacy seriously. This “Privacy Policy” describes how we handle your Personal Data in connection with our website, applications, and services which allow you to compare and evaluate side-by-side responses from different AI models in a single interface (“Services”).

1. Personal Data we collect

We collect personal data (or other similar term as defined by applicable data protection law) relating to you (“Personal Data”) as further detailed below:

Personal Data You Provide Directly to Us.

  • Account Registration Information: you provide us with your name, contact information, and account credentials when registering for an account.  Payment information is handled by our third party payment processor, but we will have access to transaction history.

  • Communications: when you reach out to us directly (including, without limitation, by email, phone, mail, or social media), you provide us with your name, social media handle, contact information, and the contents of your message.

  • Marketing Sign-ups: when you sign up for marketing materials and newsletters, you provide us with your name and contact information.

Personal Data Collected Through Use of the Services.

  • Log/Browser Data: information about how and when you use our Services, IP address, browser type and settings; your browser may automatically send this information to us when you use the Services.

  • Usage Data: information about how you interact with the Services, such as views, actions, feature use, timezone and country-level information.

  • Device Information: information about your device, such as device ID, operating system, and browser type; information varies by type of device.

  • Cookies: we use cookies as more fully described in the Cookie Information page.

  • Analytics: information about how you interact with the Services that enables us to optimize your experience.

  • De-Identified Data: In some cases, we may aggregate and/or de-identify your Personal Data in such a manner that it can no longer identify you (“De-Identified Data”).  For avoidance of doubt, De-Identified Data is not considered Personal Data.

  • User Data: input or prompts you provide when using the Services (“User Data”). 

  • Output: output generated and returned by the Services based on the User Data (“Output”).

Personal Data We Receive From Third Parties.  Third parties may provide Personal Data to GMTech.  A list of third party services incorporated into the Services and Third Party Terms is available here, and may be updated from time to time.

2. How We Use Personal Data

We use Personal Data to:

  • Provide, troubleshoot, and improve the Services, and to develop new ones

  • Administer your account

  • Communicate with you 

  • Deliver marketing materials and other commercial purposes

  • Conduct research and other internal purposes

  • Protect the security of our systems, and prevent crime, fraud, violations of law or infringement of proprietary rights, or other misuse

  • Comply with the law and our obligations to other parties, and to protect our rights

  • Use otherwise as permitted by applicable law or for any other uses you have consented to

We use De-Identified Data to: analyze the performance of our Services, to optimize and improve our Services, conduct research, understand our users, and to share aggregated user statistics with third parties and the public. 

3. How We Share Personal Data

We will share your Personal Data in the following situations:

  • Business Partners: We may share Personal Data with our business partners, vendors, and service providers, who provide us with services to administer our business.

  • Mergers & Acquisitions: In the event of any potential merger, acquisition, reorganization, bankruptcy, or other business transition, we may share your Personal Data with other parties as part of our diligence process, and we may transfer your Personal Data to another party as part of any change in ownership.

  • As Required by Law or Other Obligations: We may share your Personal Data with third parties, including, without limitation, to courts, regulatory authorities, and law enforcement agencies,  if required by law or to comply with a legal obligations, to protect or defend our rights, including for violation of our terms, policies, or the law, to prevent fraud or other illegal activity, to protect the security of our Services, personnel, end users, or the public, and to otherwise protect ourselves from legal liability.

  • Forums.  Where we offer public-facing forums, the Personal Data you disclose on such forums will become public.

  • With Your Consent.  From time to time, we may ask if you would like us to share your Personal Data with other third parties not described in this Privacy Policy, and we will only do so if you consent.

4. Exercising Your Privacy Rights

Depending on where you are located, you may have certain rights under law regarding your Personal Data.  To exercise your rights, please send your request to privacy@gmtech.com.

5. User Age

Our Service is not intended to be used by anyone under the age of 18. As a user, you represent and warrant that you are at least 18 years of age or older when registering for an account.  GMTech does not knowingly collect Personal Data from individuals under the age of 18. 

6. Third Party Links

The Services may contain links to third party websites not under the control of GMTech. If you share Personal Data with those third parties, it will be governed by the third party’s privacy policies and terms of use. GMTech is not responsible for their practices.

7. Security and Data Retention

We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Data both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, nothing on the internet is fully secure. 

Personal Data is retained for the period of time necessary to provide Services to you or for the other purposes listed in this Privacy Policy or the Terms of Use, as determined by a number of factors, including, without limitation, any legal requirements or industry standards. In some cases, our business partners (such as our third-party payment processor) may have their own data retention periods, which we have no control over.

8. Jurisdiction-Specific Terms

U.S. State

Your Privacy Rights. To the extent provided for by local law and subject to applicable exceptions, individuals may have the following privacy rights in relation to their Personal Data:

  • The right to know information about our processing of your Personal Data, including the specific pieces of Personal Data that we have collected from you;

  • The right to request the deletion of your Personal Data.

  • The right to correct your Personal Data; 

  • The right to be free from discrimination relating to the exercise of any of your privacy rights.

  • If applicable, the right to opt out of the sale or sharing of your Personal Data.

  • If applicable, the right to limit the use and disclosure of sensitive Personal Data (for example, your social security number, financial account information, your precise geolocation data, or your genetic data) collected about you.

International (outside the United States)

  • Transfer.  GMTech is based in the U.S.  Your Personal Data will be processed by GMTech in the U.S. and may be shared with the parties listed in this Privacy Policy with locations in other countries, including in the U.S and with GMTech’s hosting provider located in Germany.

  • Legal Basis.  Where required by law to share the legal basis for processing, GMTech may process your Personal Data for the following legal bases:

    • Performance of a contract

    • Legitimate interest

    • Compliance with law

    • Consent, where required

9. Updates

GMTech reserves the right to update this Privacy Policy from time to time. We will post updates to the website, or, for any material change, send a notice in-product or to the email address we have on file for your account.  Updates will take immediate effect unless otherwise noted in any notice.  Your continued use of the Services after such update represents your agreement to the updated Privacy Policy.
